  1. Account Creation; Usage Limits

    1. Account Creation. You must create an account to use the Licensed Software. When you register for an account via the Licensed Software you must ensure that all information you provide to us is accurate and kept up to date. Upon registration we grant to you the limited, personal, non-transferable right and licence to access and use the Licensed Software solely for your own internal use, or your own internal business purposes. You are responsible for all activity that occurs under your account. You also must use the Licensed Software in compliance with the Acceptable Use Policy (available at https://n8n.io/legal/customer-acceptable-use-policy/).
    2. Keep it Safe. You must keep your account details safe. Any piece of information as part of our security procedures including your username and password must be treated as confidential. We have the right to disable any user identification code or password at any time. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at [email protected].
    3. Subscription Details. A certain number of days will be made available to you at no cost as a free trial period. The duration of the free trial period will be clearly communicated to you in the Licensed Software. During the free trial period, the Licensed Software will be provided to you “AS-IS”, and we will not provide any guarantees or protections as to its performance or your use of it. Upon expiration of the free trial period, you will only be able to continue using the Licensed Software if you pay the relevant fees, and begin a “Subscription”. For each Subscription, you will be liable to pay for all taxes and duties imposed by the relevant authorities, as all prices listed via the Licensed Software are exclusive of these. We may change our subscription plans, usage limits, features and prices from time to time. Any change to the price of your Subscription will take effect from your next renewal following notice of the change (unless we tell you otherwise and applicable law permits the change to take effect earlier). If you do not agree to the change, you may cancel your Subscription before the change takes effect. To terminate your subscription, you can do so via the Licensed Software or by email at: [email protected].
    4. Subscription Fees and Payment Terms. Where you sign up to a monthly plan with us, all Subscription fees will be payable in advance at the beginning of each month. You will be able to cancel your monthly subscription at any time which will give you access to the Licensed Software until the end of that month, after which no further payments will be taken and your account will terminate. If you sign up to an annual Subscription, you will have access for 12 consecutive months, and the fees will be payable in advance. Subject to your right to opt-out, as set out in clause 1.8 below, all fees (for both monthly and annual plans) are non-refundable. Subscription plans automatically renew unless notice of cancellation is received.
    5. Third-Party Services. The Licensed Software enables connections to third-party applications, APIs, platforms, data sources, and community-developed nodes and extensions (each and collectively, "Third-Party Services"). Access to and use of any Third-Party Service is at your sole risk. If you connect a Third-Party Service, including by granting OAuth authorizations, storing credentials in n8n's credential manager, or installing community nodes, you are solely responsible for the permissions, scope, actions, and data transmitted. We are not liable for workflow failures or data inaccuracies caused by Third-Party Service downtime, deprecation, rate limits, or API modifications.
    6. Usage limits and Overages. Your Subscription is subject to the usage limits applicable to your plan. Some plans are capped, and no excess usage may be consumed. If your plan is not capped, and if you exceed those limits, we will charge you the applicable overage fees. In our sole discretion, we may discuss an appropriate upgrade for your usage. Applicable usage limits and overage fees will be communicated to you through the Licensed Software. You are responsible for all charges resulting from usage of your account, including all overages incurred, which will be billed in accordance with the features chart on the pricing chart page, effective as of the date of your Subscription renewal. We may suspend or restrict further usage if applicable usage charges are not paid when due.
    7. Merchant of Record. When you pay for your Subscription, we will use a merchant of record to process payment. Any invoices or payments from your account will be under the name of the said merchant of record, which may be updated from time to time with 30 days’ notice. You authorise us and our payment providers/merchant of record to charge your selected payment method for Subscription fees, usage charges or other amounts due under these Terms. If payment cannot be collected when due, we, or our merchant of record, may retry the payment method and may suspend or restrict your access to the Licensed Software until all outstanding amounts have been paid.
    8. Right to Opt-Out. Certain individuals in the EU and the UK have statutory cancellation rights. Business customers are not entitled to a right to withdraw. All Subscription fees are final; n8n does not refund unused or partially used Fees. By way of exception, consumers may have a statutory right of withdrawal, save for situations where Fees are available for immediate use, and Customer consents to immediate use and waiving of their right of withdrawal.
  2. Licensed Software

    1. Content you provide. Anything you upload, submit or run through the Licensed Software, including your workflows, is Customer Content and remains private to you by default. You may choose to share workflows or post on our community forum, in which case that material is Community Materials and is available for other users to view, use and adapt in their own projects.
    2. Performance of the Licensed Software. During your use of the Licensed Software, we will take steps to ensure that the Licensed Software functions as described in the Documentation. Although we will introduce technology to prevent malware and viruses we do not guarantee that the Licensed Software will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access the Licensed Software. Additionally, all self-hosted customers are responsible for their own environment, network security, and any community nodes or custom components installed. In the event you report to us a substantial error with the Licensed Software, we will seek to correct this within a reasonable amount of time – where legally permitted, this will be your sole remedy. Additionally, we will not be responsible, and disclaim any responsibility, for any loss of Customer Content due to a disruption in your telecommunications or internet services.
    3. Deployment Modes. The Licensed Software may be deployed in either a cloud-hosted or self-hosted environment. Cloud-hosted licences will be supported by our subprocessors, available: https://n8n.io/legal/sub-processors/ and as applicable for your region, and we may process personal data input as part of the Customer Content; for all Customer Content that n8n processes for you, the data processing agreement found at https://n8n.io/legal/data-processing-agreement/ shall apply. Licences deployed in a self-hosted environment are under your control. For self-hosted deployments only, we additionally grant you a non-exclusive, limited, non-sublicensable, non-transferable licence to install and use the Software in object code form only as delivered pursuant to these Terms; and use the Documentation as necessary for its use of the Software. In such instances, we are not your processor and the data processing agreement will not apply.
    4. Suspension; Restriction. We may suspend or withdraw the Licensed Software. We do not guarantee that the Licensed Software, or any of the Website Content, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the Licensed Software for business and operational reasons. We may modify, update, replace or discontinue features or functionality of the Licensed Software from time to time. We may also introduce new features or impose or change reasonable limits on the use of the Licensed Software. Where a change materially reduces the core functionality of a paid subscription during its then-current subscription term, we will provide reasonable notice where practicable.
    5. Breach of the Terms. When we consider that a breach of these Terms has occurred, we may take such action as we deem appropriate including:
      1. immediate, temporary or permanent withdrawal of your right to use the Licensed Software;
      2. immediate, temporary or permanent removal of any Customer Content uploaded by you via the Licensed Software;
      3. legal action against you; and/or
      4. disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
    6. Disclaimer. Where the Licensed Software contains links to other sites, Community Materials and resources provided by third parties, these are provided for your information only. They should not be interpreted as approval by us of those linked websites or information you may obtain from them.
    7. AI features. For certain Subscriptions, AI features may be made available to you in certain version releases. These are subject to the AI Terms, defined above. You must not use the AI features in violation of applicable law or the AI Terms. n8n will not use Customer Content or Output (as defined in the AI Terms) to train machine learning models. Certain aggregated and anonymized Usage Data may be used to improve our Services, which you may opt-out of via the in app settings.
    8. Sandbox Environments. Certain AI features allow you to execute code in temporary sandbox environments operated by n8n. Relevant Customer Content, as well as prompts, workflows, files and execution data, may be transmitted to these Sandbox Environments. You are responsible for any code, applications or content you create, execute or publish through them, including compliance with the AUP in your use of them.
  3. Content and Security

You agree to indemnify n8n against any third-party claims arising from your publication or sale of such workflow templates, including any unauthorised disclosure of information or infringement of third-party rights. We reserve the right to remove any workflow at our discretion.

They must not: (i) Be defamatory of anyone or be seen as bullying, insulting, intimidating, discriminating or humiliating someone; (ii) be unlawful; (iii) promote sexually explicit material; (iv) promote violence; (v) infringe any copyright, database right or trade mark; (vi) be deceptive; (vii) give the impression that the your services originate from us or another person for which you do not have authority from; (viii) contain any advertising or promotion for another company and/ or site; and (ix) knowingly introduce viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful.
    5. Customer Content. You are responsible for the accuracy, quality and legality of all Customer Content and for the means by which you acquired it. For cloud-deployments, you represent and warrant that you have all rights necessary to permit n8n to use, store, disclose and otherwise process Customer Content as contemplated by these Terms.
    6. Use Limitations. You will not reverse engineer or otherwise attempt to derive or obtain information about the functioning, manufacture or operation of the Licensed Software. Nor will you attempt to modify, translate, or create derivative works based on the Licensed Software; or copy (save for archival purposes), rent, lease, distribute, pledge, assign or otherwise transfer or encumber rights to the Licensed Software. You acknowledge and agree that you can only use the Licensed Software for internal business purposes only and may not transfer, sell, distribute, lease, sublease, assign or licence to any third parties. You must not attempt to gain unauthorized access. Whether this is to the Licensed Software, the server on which the Licensed Software id stored or any server, computer or database connected to the Licensed Software. You must not attack the Licensed Software via a denial-of-service attack or a distributed denial-of service attack. We will report any such breach to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Licensed Software will cease immediately.
  4. Intellectual Property

    1. Of the Licensed Software. We are the owner or the licensee of all intellectual property rights in the Licensed Software including any modifications and improvements, whether made by us or suggested by you. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. We provide you with a worldwide, non-exclusive, non-transferable, non-sublicensable, revocable, and limited term licence for internal use only to use the Licensed Software in accordance with these Terms. Such a right to use the Licensed Software and any Customer Content and Community Materials on the Licensed Software will expire at the point your Subscription ends or when we terminate these Terms, whichever is sooner.
    2. Of Customer Content. You retain all rights, title and interest in your Customer Content. Solely for cloud-hosted deployments, you grant n8n a non-exclusive, royalty-free, fully paid, worldwide licence (with the right to sublicense to n8n's subcontractors and third-party service providers performing services for n8n) to access, use, reproduce and create derivative works of Customer Content solely to provide and support the Licensed Software.
    3. Of Community Materials. You and other users retain all intellectual property rights in the Community Materials you each create. Where you choose to share Community Materials publicly, you grant n8n a worldwide, royalty-free, non-exclusive, transferable and sublicensable right to use, modify and distribute that Community Materials, and you grant other users a non-exclusive licence to use and adapt it in their own projects. You acknowledge that where n8n independently creates content materially similar to Community Materials you have made public, you will have no claim against n8n, including for infringement or misappropriation.
    4. Usage Data. “Usage Data” means information relating to your use, access, instructions, configuration and operation of the Licensed Software, which may include technical logs, metadata, telemetry data, or workflow configurations generated through your use of the Licensed Software (but excluding Customer Content). If you are a self-hosted deployment, you may opt out of the collection of most of the Usage Data by following the steps in the Documentation. Notwithstanding any such opt-out, we will continue to collect licensing metadata which is transmitted separately via the licence server for compliance and billing purposes. For the sake of clarity, no Customer Content is included in this metadata. Any use of the licensing metadata by us contemplated by the preceding sentence shall be internal-only, and we will not use such licensing metadata or any personal data included therein to perform services on behalf of another person or entity. We may also use telemetry data to improve and monitor the performance of the Services, provided that such data is anonymized and de-identified.

    3. Deletion of data. We will only retain your Customer Content for as long as we need it. Your Customer Content is deleted when you delete your account, or otherwise within 100 days after the deactivation of your account with us, unless we are required to keep it for longer to comply with our legal, accounting or regulatory requirements. When possible, we will contact you by email 30 days before deactivating and deleting your account. Usage Data may be retained in aggregated or de-identified form.
  6. Indemnity

    You agree to indemnify us, our affiliates, directors, officers and employees against all loss, costs, damages, liabilities and expenses that arise out of your breach of these Terms and/or use of the Licensed Software. If a third party makes a claim for which you are required to indemnify us under these Terms, we will notify you of the claim as soon as reasonably practicable. You will provide us with reasonable assistance in defending or settling the claim, at your cost. You may not settle any claim in a manner that admits liability on our behalf, imposes any obligation on us, or otherwise adversely affects us without our prior written consent.

    2. As our service grows and improves, we might have to make changes to these Terms. We will do this by uploading the latest version with a date confirming when they take effect. Where your subscription renews on a monthly basis, any updated Terms will apply from the start of your next monthly renewal period following notice of the changes. By continuing to use our service after that date, you agree to the updated Terms. We also reserve the right to update the pricing for our plans, and for overages, by providing sufficient notice to you.
